The terms and conditions herein together with any notices or conditions on other areas of this website will all together govern use by customers of this website. You should note that JANINE TONKIN may at any time make changes to or remove part of this website without any liability to customers for such changes. JANINE TONKIN reserves the right to change these terms and conditions in the future without specifically notifying customers and continued use of the website or placing of orders after such changes shall be deemed to be acknowledgement and acceptance thereof.

To shop with Janine Tonkin, you need to:

When you as a customer place an order via this website, you warrant by placing the order that:

- You are not a minor or otherwise legally incapable of entering into a binding contract. 

- The personal details which you give us on registration are fully complete and accurate. 

- You are not using a false name or the name of any other person or body which you are not authorised to use.

- Be at least 16 old; 

- Have a debit or credit card that we accept. Please see bottom of page of current payment providers;

and 

- Be authorised to use that credit or debit card. Example, it is in your name or you have permission to use it.

Some of the goods sold through our website(s) may not be suitable for under 18’s.

Order Placement & Product Price Indication

When you place your order you are doing so in acceptance of these terms and conditions and it is important that you have read them before you go ahead and order.

A contract will only come into existence between you the customer and us once your order has been processed and dispatched.

All orders are subject to availability and confirmation of the order price. If there’s an issue with an order, we’ll get in touch with you. The main characteristics of the products are shown on each product page on janinetonkin.com The images and the products offered for sale on janinetonkin.com may not correspond exactly to the true physical product due to the Internet browser, smart phone or monitor used by the customer.

From time to time, we may price an item or order wrongly. If we discover an error for any goods you’ve ordered, we will tell you ASAP and give you the option of reconfirming your order (at the correct price) or cancelling it. If we can’t get in touch with you, we will treat the order as cancelled. 

As a customer, you are free to cancel an order within 14 days and will be refunded amount of your order to their account the order originally was paid from. However, should the order already be dispatched this will not apply.

Please note that a change of mind to your order outside of the 48 hour window will not be accepted and the deposit payment will be kept by JANINE TONKIN. 

From time to time, prices are subject to change in response to currency exchange rate changes and other commercial factors. All prices include VAT (where applicable) at the applicable current rate chargeable in the UK at that time. If the rate of VAT changes between the date of your order and the date of delivery, we will adjust the VAT you pay, unless you have already paid for the products in full before the change in VAT takes effect. JANINE TONKIN is not responsible for conversion fees and exchange rates. 

Any discount codes issued are subject to the individual terms and conditions with which they were issued, which may include, amongst other things, eligibility of use and maximum order value. If any of the terms and conditions with which the discount codes were issued contradicts these terms and conditions, the terms and conditions in respect of the discount code will prevail. We reserve the right to reject or cancel any orders which do not comply with these terms even if your credit or debit card has been charged (and will refund in full any amounts paid by you in respect of the order). Please check the final price before placing your order. In the event of in the indication - by Janine Tonkin - of the product price or calculation of the amount requested at payment being incorrect, JANINE TONKIN will reject the order and contact the user to offer them the opportunity to purchase the product or products at the correct price. The purchase price of the product(s) and the cost for their delivery as indicated on the order summary page will be charged to your account at the moment in which your order is shipped.

Ordering Conditions

By clicking on the “Confirm and Pay” button, you enter into an obligation to pay for the Product(s). English is the language used for the contract with JANINE TONKIN and our respective partner’s, customers and staff. After your order has been placed, we will process your order. You will receive an automatic order confirmation notification from us. This does not constitute acceptance of your order by JANINE TONKIN nor does a contract between JANINE TONKIN and the customer exist at this point in time.  JANINE TONKIN’s acceptance of your order will take place when the we email you to confirm that the order has been dispatched. A contract will come into existence between you and JANINE TONKIN. The acceptance email represents an electronic purchase order receipt. After entering into a contract, you are obligated to pay off the total price of the artwork as per the agreed timeframe. When an order is placed you will get an order confirmation sent to the email address you provided during checkout, containing information about order content, prices.

JANINE TONKIN are not obliged to fulfil an initial order and can reject an order at our or their discretion.

You as a buyer are free to choose from mentioned and at the time relevant delivery option(s). Janine Tonkin assumes no responsibility for damages during transport or damages caused from any delays beyond its control:

Janine Tonkin accepts returns within 14 days if products are not used, changed, washed or otherwise manipulated. Products need to be returned in original packaging. This would be at a cost to yourself.

No products may be returned to Janine Tonkin without the prior written consent of Janine Tonkin and are subject to a return charge.

Your rights are protected by the Sale of Goods and Supply of Services Act, 1980, and also the Consumer Protection Act, 2007, where you are a consumer. Nothing in this website shall affect your rights under the applicable law. If any of these terms and conditions shall prove to be void, unlawful, or unenforceable for any reason then such term or condition shall be deemed to be severed from the remaining terms and conditions which shall remain valid and enforceable. If any provision of these terms and conditions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

JANINE TONKIN Role & Responsibilities

When you complete a purchase on janinetonkin.com you enter a contract with JANINE TONKIN which supplies the product. We provide a platform which we trade our products to you, the consumer. We complete a sale and process payments, refunds & shipping. Once we receive your full payment for an order, we will remove your debt obligation to JANINE TONKIN for that order.

Shipping is handled by JANINE TONKIN through Royal Mail.  JANINE TONKIN shall not be held liable for any delays arising from actions or failures of the shipping company, nor for any disruptions, obstacles, or unforeseen circumstances that the shipping company may encounter. This includes, but is not limited to, delays due to logistical issues, labour strikes, natural disasters, or other events beyond control.
