These Terms and Conditions govern the use of this website, any associated online stores, purchases, commissions, bookings, workshops, consultations, mural projects, community art initiatives and all products and services supplied by Janine Tonkin Art.

By accessing this website, placing an order, requesting a quotation, downloading content, engaging with Janine Tonkin Art or entering into any agreement with us, you acknowledge that you have read, understood and accepted these Terms and Conditions.

If you do not agree with these Terms, you should not use this website or purchase any products or services.

Throughout these Terms:

"Janine Tonkin Art", "we", "our", and "us" refers to Janine Tonkin trading as Janine Tonkin Art, a sole trader registered in the United Kingdom, together with any future limited company, successor business or associated trading entity operated by Janine Tonkin.

The term "Customer", "Client", "Visitor", "Purchaser", or "You" refers to any individual, organisation, business, charity, local authority, educational establishment, housing association, contractor or third party interacting with Janine Tonkin Art.

These Terms apply unless a separate written agreement has been signed by both parties.

Where purchases are made on behalf of organisations, councils, charities or companies, the purchaser confirms they have authority to bind that organisation.

6. Products

Every artwork created by Janine Tonkin is an original creative work.

Products may include:

original paintings

museum-quality prints

framed artwork

apparel

books

journals

homeware

educational products

digital resources

licensed products

Colours may vary slightly depending on:

monitor settings

mobile devices

printers

lighting conditions

manufacturing processes

Such differences do not constitute faults.

As many products are handmade or produced using specialist printing methods, slight variations form part of the artistic nature of the work.

7. Product Availability

Some products are:

made to order

produced by specialist print partners

handmade

limited edition

one-of-a-kind

Availability cannot always be guaranteed.

If an item becomes unavailable after purchase we will contact you promptly to discuss:

an estimated delay

a suitable alternative

or a refund where appropriate.

8. Pricing

Prices are shown in Pounds Sterling (£) unless otherwise stated.

Prices may change without notice.

The price charged will be the price displayed at the point your order is accepted.

Occasionally pricing errors occur.

Where a genuine pricing error exists we reserve the right to:

cancel the order

refuse the order

offer the product at the correct price

No contract exists until your order has been accepted.

9. Payment

Payment may be processed through approved payment providers including but not limited to:

SumUp

PayPal

Stripe

major debit cards

major credit cards

other approved payment methods

Orders will not normally begin processing until payment has cleared.

We reserve the right to decline payment methods where fraud is suspected.

10. Orders

Submitting an order does not automatically create a legally binding contract.

Your order represents an offer to purchase.

Acceptance occurs only when:

payment has been authorised

the order has been reviewed

and we confirm acceptance by dispatch or written confirmation.

We reserve the right to decline orders at our discretion.

Reasons may include:

suspected fraud

pricing errors

unavailable stock

abusive behaviour

legal restrictions

technical errors

safeguarding concerns

circumstances beyond our reasonable control

11. Bespoke Commissions

Commissioned artwork, murals and bespoke projects are individually agreed.

Each commission is unique.

A quotation, proposal or concept document does not constitute acceptance of a commission.

Acceptance occurs only once both parties agree the scope of work.

Where deposits apply in future, they will be subject to the terms contained within the relevant Commission Agreement.

Unless otherwise agreed in writing, any deposit paid for a bespoke commission becomes non-refundable once creative work has commenced, as it contributes towards time, research, design development, planning and creative services already provided.

12. Delivery & Fulfilment

Janine Tonkin Art works with carefully selected fulfilment partners to ensure customers receive high quality products.

Depending on the product ordered, fulfilment may be carried out by:

Teemill

other approved specialist production partners

Products may therefore arrive separately if ordered together.

Estimated delivery times are provided as guidance only and are not guaranteed.

While every effort is made to dispatch orders promptly, delays may occasionally occur due to:

high order volumes

public holidays

supplier delays

courier delays

weather conditions

customs processes

industrial action

illness

circumstances beyond our reasonable control

We will always endeavour to keep customers informed where significant delays arise.

13. Royal Mail Deliveries

Where products are dispatched directly by Janine Tonkin Art they are normally sent using Royal Mail or another suitable postal or courier service.

Delivery times quoted by Royal Mail are estimates only.

Janine Tonkin Art cannot guarantee delivery dates once parcels have been accepted by the postal service.

Risk in goods transfers upon successful delivery to the delivery address supplied by the customer unless otherwise required by applicable consumer law.

14. Drop Shipped Products

Some products are manufactured and dispatched directly by trusted fulfilment partners.

These include but are not limited to:

Fine art prints

Framed prints

Canvas prints

Apparel

Homeware

Certain stationery

Sustainable clothing collections

Production times vary according to supplier schedules.

Customers acknowledge that made-to-order products require production before dispatch.

15. Multiple Deliveries

Where an order contains products supplied by different fulfilment partners your order may arrive in separate deliveries.

Additional delivery charges will not normally be applied unless clearly stated before purchase.

16. Delivery Address

Customers are responsible for providing accurate delivery details.

Janine Tonkin Art accepts no responsibility for delays or losses resulting from incorrect or incomplete delivery information supplied by the customer.

Additional delivery charges resulting from incorrect addresses may be payable by the customer.

17. Failed Deliveries

Where parcels are returned due to:

incorrect addresses

failure to collect

refusal of delivery

repeated failed delivery attempts

the customer may be responsible for additional shipping costs before re-dispatch.

18. Inspection of Goods

Customers should inspect products as soon as reasonably possible following delivery.

If goods arrive damaged or defective customers should notify Janine Tonkin Art within 48 hours where possible and provide clear photographs of:

the product

the packaging

the shipping label

the damage

Prompt notification assists us in resolving claims with our fulfilment partners.

19. Original Artwork

Original artwork is unique.

Minor characteristics including brush marks, texture, mixed media elements, resin variations, gold leaf characteristics and handmade finishes form part of the artistic process and are not considered defects.

Certificates of Authenticity supplied with original artwork should be retained by the purchaser.

20. Fine Art Prints

Prints are produced using museum-quality materials wherever specified.

Colours may differ slightly due to:

screen calibration

lighting

paper type

printing processes

These variations do not constitute faults.

21. Sustainable Apparel

Apparel supplied through Teemill is manufactured to order.

Customers should carefully review sizing information before purchase.

As garments are made specifically for each customer, returns for incorrect sizing or change of mind may not be accepted unless required by law.

22. Right to Cancel

Where applicable under UK consumer legislation customers may have the statutory right to cancel certain purchases within the applicable cancellation period.

However, this right does not normally apply to:

bespoke artwork

commissioned work

personalised items

made-to-order products

customised products

products manufactured specifically for the customer

Nothing within these Terms limits statutory consumer rights.

23. Change of Mind

Because many products are created specifically following an order, Janine Tonkin Art is unable to accept returns for change of mind on made-to-order products unless required by law.

Where returns are accepted, goods must be:

unused

undamaged

in original packaging

suitable for resale

Return postage remains the customer's responsibility unless the return results from our error or a faulty product.

24. Damaged or Faulty Goods

If goods arrive damaged or defective we will work with the relevant fulfilment partner to resolve the issue as quickly as possible.

Depending upon circumstances this may include:

replacement

repair

partial refund

full refund

Each claim is assessed individually.

25. Bespoke Commissions & Murals

Due to the significant creative time invested in commissioned artwork, murals and bespoke design work:

quotations remain valid only for the period stated

deposits secure project scheduling

creative work may begin before physical production

deposits become non-refundable once creative work has commenced unless otherwise agreed in writing

Where a client chooses to cancel a commission after work has begun, Janine Tonkin Art reserves the right to invoice for work completed to date including research, consultation, design development, planning, travel and administration.

26. Force Majeure

Janine Tonkin Art shall not be liable for delays or failure to perform obligations where such failure results from circumstances beyond reasonable control including but not limited to:

severe weather

flooding

fire

pandemics

industrial disputes

supplier failures

postal disruption

cyber attacks

utility failures

acts of government

civil unrest

natural disasters

Performance shall be suspended for the duration of such events.

27. Ownership of Goods

Ownership of physical products transfers to the customer only once payment has been received in full.

Ownership of the physical item does not transfer ownership of any intellectual property rights associated with that item.

The purchase of artwork, prints, apparel, books, murals, digital products or any other product supplied by Janine Tonkin Art does not grant permission to reproduce, distribute, publish, adapt, digitise, commercially exploit or create derivative works from that product unless expressly agreed in writing.

28. Intellectual Property

All intellectual property rights remain the exclusive property of Janine Tonkin Art unless expressly assigned by written agreement signed by both parties.

These rights include, but are not limited to:

Drawings

Sketches

Designs

Murals

Public art

Illustrations

Digital artwork

Colour palettes where protected by law

Surface pattern designs

Graphic designs

Logos

Branding

Product designs

Photographs

Videos

Website content

Written content

Educational resources

Workshop materials

Presentations

Creative proposals

Design concepts

Storyboards

Frameworks

Artistic methodologies

Community engagement methodologies

Any future trademarks, registered designs, copyrights or other intellectual property owned by Janine Tonkin Art.

29. Acceptable Use

Visitors must not use this website or any content supplied by Janine Tonkin Art to:

infringe copyright

copy artwork

reproduce designs

train artificial intelligence systems without permission

scrape website content

reproduce text

remove copyright notices

impersonate Janine Tonkin Art

create misleading associations

distribute unauthorised copies

exploit content commercially

upload malicious software

interfere with website functionality

We reserve the right to suspend or restrict access where misuse is identified.

32. Accuracy of Information

Where Janine Tonkin Art provides consultancy, creative direction, workshops, mural design, presentations or educational services, professional opinions are offered in good faith based upon experience and information available at the time.

Clients remain responsible for obtaining independent professional advice where required, including legal, engineering, structural, planning, health and safety, safeguarding or financial advice.

35. Indemnity

You agree to indemnify and hold harmless Janine Tonkin Art against any claims, liabilities, losses, damages, costs or expenses arising from:

misuse of this website

breach of these Terms

infringement of third-party rights

unlawful use of our content

unauthorised commercial exploitation of our intellectual property

36. Events Beyond Our Control

Janine Tonkin Art shall not be responsible for failure or delay in fulfilling contractual obligations where such failure results from circumstances beyond our reasonable control.

transport disruption

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales unless applicable consumer legislation provides otherwise.

Janine Tonkin Art reserves the right to amend these Terms and Conditions at any time.

Continued use of the website following any updates constitutes acceptance of the revised Terms.
